Service Agreement

This Service Agreement (“Agreement”) governs all pest control services provided by Huron Spider Control Inc. (“Company”, “we”, “our”, or “us”) to the customer (“Client”, “Customer”, “you”, or “your”). By scheduling, authorizing, or receiving services, you agree to be bound by this Agreement.

Service Authorization
By scheduling service, signing a service order, or allowing our Spider Control Specialists (exterminator or technician) to perform treatment on the property, the Client authorizes Huron Spider Control Inc. to:
Inspect the property for spider activity and conducive conditions.
Apply pest control products where deemed appropriate.
Remove spider webs and egg sacs.
Install preventative treatment barriers.
Access areas reasonably necessary to complete treatment.
Authorization may be given verbally, electronically, or in writing and shall be legally binding.
Scope of Services
Services provided are intended to control and reduce spider populations, not permanently eliminate all spiders.
Spider migration from surrounding properties, vegetation, and environmental factors is unavoidable. Because spiders naturally move between properties, complete eradication cannot be guaranteed.
Services may include the following:
Exterior perimeter treatments.
Structural barrier applications.
Web removal.
Inspection and preventative treatment.
Follow-up treatments when applicable.
Service methods, materials, and treatment locations are determined solely by the Company based on professional judgment.
Pesticide Application Consent
Client acknowledges and agrees that pest control services may involve the application of pesticide products registered under Canadian law.
Products used may be regulated under the Pest Control Products Act.
By accepting service, the Client:
Consents to the application of pest control products on the property.
Confirms occupants have been informed of the scheduled treatment.
Accepts responsibility for following any post-treatment instructions.
The Client must notify the Company before treatment if any occupant has:
Chemical sensitivities.
Respiratory illness.
Allergies to pesticides.
Pregnancy concerns.
Sensitive animals.
Failure to disclose such conditions releases the Company from liability related to exposure.
Client Responsibilities
Effective spider control depends on environmental conditions and property maintenance.
The Client agrees to:
Provide safe and reasonable access to the property.
Secure pets and occupants during treatment if required.
Maintain general sanitation and property upkeep.
Remove excessive clutter or obstructions when requested.
Follow all preparation and post-treatment instructions.
The guarantee may be void if the Client fails to address conditions listed under Client Responsibilities.
60-Day Spider Control Guarantee
Huron Spider Control Inc. provides a 60-Day Spider Control Guarantee on qualifying services.
If a spider infestation occurs within 60 days of treatment, the Company will provide one complimentary re-treatment of previously treated areas.
Guarantee conditions:
The guarantee applies only when all of the following conditions are met:
Payment for services has been made in full.
The property conditions remain substantially unchanged.
The Client has not removed treatment barriers through washing, painting, renovation, or landscaping changes
Spider activity occurs within treated areas.
Guarantee exclusions include:
Untreated areas of the property.
New infestations from adjacent properties or structures.
Excessive environmental spider pressure (e.g., overhanging trees, foliage against structure).
Severe weather removing treatment barriers.
Structural conditions conducive to infestation.
Pressure washing or chemical cleaning after treatment.
The Company’s sole obligation under this guarantee is a re-service treatment.
Refunds are not provided once service has been performed.
Service Limitations
The Company does not guarantee the elimination of:
Spiders migrating from neighboring properties.
Spiders introduced by transported goods or materials.
Spiders entering through structural gaps or open doors/ windows.
Insects that attract spiders to the property.
Spider control treatments reduce activity but do not create a permanent pest-free environment.
Limitation of Liability
To the fullest extent permitted by law, Huron Spider Control Inc. shall not be liable for:
Incidental damages.
Indirect damages.
Consequential damages.
Emotional distress.
Business interruption.
Loss of income or property value.
The Company’s maximum liability for any claim shall not exceed the amount paid for the service giving rise to the claim.
Property Damage Disclaimer
The Company shall not be responsible for damage resulting from:
Pre-existing structural defects.
Hidden wiring or plumbing.
Loose siding or trim.
Fragile surfaces.
Improperly sealed windows or doors.
The Company is also not responsible for damage caused by insects, spiders, or other pests.
Weather and Environmental Conditions
Weather may affect the timing or effectiveness of pest control services.
Treatments may be rescheduled due to:
Heavy rain.
Extreme wind.
Freezing temperatures.
Unsafe working conditions.
The Company may determine the timing of treatment at it’s sole discretion to:
Ensure treatment effectiveness.
The safety of our Spider Control Specialists.
Payment Terms
Payment must be made within 14 days of the service date unless otherwise agreed in writing.
Accepted payment methods may include:
Electronic transfer.
Cash.
Unpaid balances may result in:
Service suspension.
Collection or legal actions.
Additional administrative fees where permitted by law.
Dispute Resolution and Arbitration
Any dispute arising from services provided by Huron Spider Control Inc. shall first be addressed through good-faith negotiation.
If a dispute cannot be resolved, the parties agree to resolve the matter through binding arbitration in Ontario, rather than court litigation, where permitted by law.
Each party shall bear its own legal costs unless otherwise awarded by the arbitrator.
Indemnification
The Client agrees to indemnify and hold harmless Huron Spider Control Inc. and its employees from any claims arising from:
Inaccurate information provided by the Client.
Unsafe property conditions.
Failure to follow treatment instructions.
Undisclosed health sensitivities or hazards.
Force Majeure
The Company shall not be liable for delays or failure to perform services due to events beyond reasonable control, including:
Natural disasters.
Severe weather.
Government restrictions.
Supply shortages.
Labor disruptions.
Privacy Policy
Client information is collected solely for service delivery, scheduling, billing, and communication.
Personal information will not be sold or shared except where required by law.
Governing Law
This Agreement shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein.
Any legal proceedings must be filed within the Province of Ontario.
Entire Agreement
This Agreement constitutes the entire agreement between the Client and Huron Spider Control Inc.
No verbal statements or representations shall modify this Agreement unless confirmed in writing by the Company.
Acceptance of Terms
By scheduling service, authorizing treatment, or permitting work to be performed on the property, the Client confirms that they have:
Read the Terms of Use.
Understood the Terms of Use.
Agreed to be legally bound by the Terms of Use.
